lēmumu Nr.2/98 par izmaiņām Eiropas līguma, kas izveido asociāciju

starp Eiropas Kopienām un to dalībvalstīm, no vienas puses,

un Latvijas Republiku, no otras puses, 3.protokolā

1.pants. 1999.gada 8.decembrī Briselē parakstītais Latvijas Republikas un Eiropas Savienības Asociācijas Padomes lēmums Nr.2/98 par izmaiņām Eiropas līguma, kas izveido asociāciju starp Eiropas Kopienām un to dalībvalstīm, no vienas puses, un Latvijas Republiku, no otras puses, 3.protokolā (turpmāk - Lēmums) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu ir izsludināms Lēmums angļu valodā un tā tulkojums latviešu valodā.

3.pants. Lēmums stājas spēkā tā 2.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

3. Protokolā

 

ASOCIĀCIJAS PADOME,

Atsaucoties uz 1995. gada 12. jūnijā Briselē parakstīto Eiropas Līgumu, kas izveido asociāciju starp Eiropas Kopienām un to Dalībvalstīm, no vienas puses, un Latvijas Republiku, no otras puses, un konkrēti tā 3. Protokola 38. pantu;

Ievērojot to, ka 3. Protokola termins "izcelsmes produkti" definīcija ir jāmaina, lai nodrošinātu paplašinātās kumulācijas sistēmas, kas pieļauj Eiropas Kopienas, Polijas, Ungārijas, Čehijas Republikas, Slovākijas Republikas, Bulgārijas, Rumānijas, Latvijas, Lietuvas, Igaunijas, Slovēnijas, Eiropas Ekonomiskas Telpas (šeit un turpmāk "EET"), Islandes, Norvēģijas un Šveices izcelsmes materiālu lietošanu, atbilstošu darbību;

Ievērojot to, ka būtu jārekomendē turpināt piemērot līdz 2000. gada 31. decembrim 3. Protokola 15. pantā minēto noteiktas likmes maksājumu sistēmu saistībā ar aizliegumu atmaksāt muitas nodokli vai atbrīvot no tā;

Ievērojot to, ka būtu nepieciešams paplašināt kumulācijas sistēmu arī uz noteiktām Turcijas izcelsmes precēm, ņemot vērā īpašās vienošanās par rūpniecības precēm starp Kopienu un Turciju;

Ievērojot to, ka ir vēlams mainīt 3. Protokola 3., 4. un 12. panta formulējumus, lai veicinātu tirdzniecību un vienkāršotu administratīvos uzdevumus;

Atzīstot, ka jāprecizē apstrādes un pārstrādes noteikumu saraksts, kas jāizpilda neizcelsmes materiāliem, lai tie iegūtu izcelsmes statusu, ņemot vērā izmaiņas pārstrādes metodēs un atsevišķu izejmateriālu trūkumu,

IR NOLĒMUSI SEKOJOŠO:

1. pants

3. Protokols par "izcelsmes produktu" jēdziena definējumu un administratīvās sadarbības metodēm tiek mainīts sekojoši:

1) 1. (i) pants tiek aizvietots ar:

"(i) par "pievienoto vērtību" tiek uzskatīta ex–works cena mīnus katra iekļautā materiāla, kura izcelsme ir kādā no 3. un 4.pantā minētajām valstīm, muitas vērtība vai, ja muitas vērtība nav zināma vai to nevar noteikt, pirmā cena, ko apstiprināmi maksā par šīm precēm Kopienā vai Latvijā.";

2) 3. un 4. pants tiek aizvietoti ar sekojošo:

"3. pants

Kumulācija Eiropas Kopienā

1. Nekādi neietekmējot 2. (1) panta nosacījumus, produkti tiks uzskatīti par Kopienas izcelsmes produktiem, ja tie ir iegūti tur, iekļaujot Kopienas, Bulgārijas, Polijas, Ungārijas, Čehijas Republikas, Slovākijas Republikas, Rumānijas, Lietuvas, Latvijas, Igaunijas, Slovēnijas, Islandes, Norvēģijas, Šveices (ieskaitot Lihtenšteinu (*)) vai Turcijas (**) izcelsmes materiālus, saskaņā ar līgumu starp Kopienu un katru no šīm valstīm Protokolu par preču izcelsmes noteikumiem nosacījumiem, un ja Kopienā veiktā apstrāde vai pārstrāde pārsniedz šī Protokola 7. pantā minēto. Šādiem materiāliem nav jābūt izgājušiem pietiekamu apstrādi vai pārstrādi.

2. Ja apstrāde vai pārstrāde, kas veikta Kopienā, nepārsniedz 7. pantā minētās darbības, iegūtais produkts tiks uzskatīts par Kopienas izcelsmes produktu tikai tad, ja tur pievienotā vērtība ir lielāka par izmantoto jebkuras no 1. paragrāfā minētās valsts izcelsmes materiālu vērtību. Ja tā nav, iegūtais produkts tiek uzskatīts par tās valsts izcelsmes produktu, kuras Kopienā ražošanai izmantoto materiālu vērtība ir vislielākā.

3. Produkti, kuru izcelsme ir kādā no 1. paragrāfā minētajām valstīm un kuri netiek pakļauti jebkādai apstrādei vai pārstrādei Kopienā, saglabā savu izcelsmi, ja tiek eksportēti uz kādu no šīm valstīm.

4. Šajā pantā noteiktā kumulācija var tikt pielietota tikai attiecībā uz materiāliem un produktiem, kas ieguvuši savu izcelsmi, piemērojot šajā Protokolā minētajiem identiskus izcelsmes noteikumus.

Kopiena ar Eiropas Kopienu Komisijas palīdzību nodrošinās Latviju ar informāciju par līgumiem un to attiecīgajiem izcelsmes noteikumiem, kas tiek piemēroti pret citām 1. paragrāfā minētajām valstīm. Eiropas Kopienu Komisija publicēs Eiropas Kopienu Oficiālajā Žurnālā (C sērija) datumu, ar kuru šajā pantā noteiktā kumulācija var tikt piemērota 1. paragrāfā uzskaitītajās valstīs, kas ir izpildījušas nepieciešamās prasības.

4. pants

Kumulācija Latvijā

1. Nekādi neietekmējot 2. (2) panta nosacījumus, produkti tiks uzskatīti par Latvijas izcelsmes produktiem, ja tie ir iegūti tur, iekļaujot Kopienas, Bulgārijas, Polijas, Ungārijas, Čehijas Republikas, Slovākijas Republikas, Rumānijas, Lietuvas, Latvijas, Igaunijas, Slovēnijas, Islandes, Norvēģijas, Šveices (ieskaitot Lihtenšteinu (*)) vai Turcijas (**) izcelsmes materiālus, saskaņā ar līgumu starp Latviju un katru no šīm valstīm Protokolu par preču izcelsmes noteikumiem nosacījumiem, un ja Latvijā veiktā apstrāde vai pārstrāde pārsniedz šī Protokola 7. pantā minēto. Šādiem materiāliem nav jābūt izgājušiem pietiekamu apstrādi vai pārstrādi.

2. Ja apstrāde vai pārstrāde, kas veikta Latvijā, nepārsniedz 7. pantā minētās darbības, iegūtais produkts tiks uzskatīts par Latvijas izcelsmes produktu tikai tad, ja tur pievienotā vērtība ir lielāka par izmantoto jebkuras no 1. paragrāfā minētās valsts izcelsmes materiālu vērtību. Ja tā nav, iegūtais produkts tiek uzskatīts par tās valsts izcelsmes produktu, kuras Latvijā ražošanai

izmantoto materiālu vērtība ir vislielākā.

3. Produkti, kuru izcelsme ir kādā no 1. paragrāfā minētajām valstīm un kuri netiek pakļauti jebkādai apstrādei vai pārstrādei Latvijā, saglabā savu izcelsmi, ja tiek eksportēti uz kādu no šīm valstīm.

4. Šajā pantā noteiktā kumulācija var tikt pielietota tikai attiecībā uz materiāliem un produktiem, kas ieguvuši savu izcelsmi, piemērojot šajā Protokolā minētajiem identiskus izcelsmes noteikumus.

Latvija ar Eiropas Kopienu Komisijas palīdzību nodrošinās Kopienu ar informāciju par līgumiem un to attiecīgajiem izcelsmes noteikumiem, kas tiek piemēroti pret citām 1. paragrāfā minētajām valstīm. Eiropas Kopienu Komisija publicēs Eiropas Kopienu Oficiālajā Žurnālā (C sērija) datumu, ar kuru šajā pantā noteiktā kumulācija var tikt piemērota 1. paragrāfā uzskaitītajās valstīs, kas ir izpildījušas nepieciešamās prasības.

(*) Lihtenšteinas Hercogistei ir muitas ūnija ar Šveici, un tā ir arī Eiropas Ekonomiskās Telpas Līguma Dalībvalsts.

(**) Šajā pantā dotā kumulācija nav attiecināma uz Turcijas izcelsmes materiāliem, kas uzskaitīti šī Protokola V Pielikuma

sarakstā.

 

3) 12. pants tiek aizvietots ar sekojošo:

"12. pants

Teritoriālais princips

1. Izņemot 2. (1) (c) pantā, 3. un 4. pantā un šī panta 3. paragrāfā noteikto, II Nodaļā aprakstītajiem nosacījumiem izcelsmes iegūšanai ir jābūt izpildītiem Kopienā un Latvijā vienmēr.

2. Izņemot 3. un 4. pantā noteikto, ja no Kopienas vai Latvijas uz citu valsti eksportētās izcelsmes preces tiek atsūtītas atpakaļ, tad tās jāuzskata par neizcelsmes precēm, ja vien muitas iestādēm nevar pierādīt, ka:

(a) atpakaļ atsūtītās preces ir tās pašas preces, kuras tika eksportētas; un

(b) tās nav tikušas pakļautas nekādām darbībām, atskaitot tās, kas nepieciešamas, lai saglabātu tās labā stāvoklī atrašanās laikā šajā valstī vai arī eksportēšanas laikā.

3. Izcelsmes statusa iegūšanu saskaņā ar II Nodaļā aprakstītajiem noteikumiem neietekmēs ārpus Kopienas vai Latvijas veiktā apstrāde vai pārstrāde materiāliem, kuri eksportēti no Kopienas vai Latvijas un pēc tam reimportēti tur, ja vien:

(a) minētie materiāli ir pilnībā iegūti Kopienā vai Latvijā vai tiem pirms eksportēšanas ir veikta apstrāde vai pārstrāde vairāk nekā 7. pantā aprakstītās nepietiekamās operācijas; un

(b) muitas iestādēm var uzrādīt, ka:

(i) reimportētās preces ir iegūtas, apstrādājot vai pārstrādājot eksportētos materiālus; un

(ii) kopējā pievienotā vērtība, kas iegūta ārpus Kopienas vai Latvijas, piemērojot šī panta nosacījumus, nepārsniedz 10% no gala produkta, kam tiek pieprasīts izcelsmes statuss, ex–works cenas.

4. 3. paragrāfa nolūkiem II Nodaļā aprakstītie izcelsmes statusa iegūšanas noteikumi neattieksies uz apstrādi vai pārstrādi, kas veikta ārpus Kopienas vai Latvijas. Ja II Pielikuma sarakstā, nosakot gala produkta izcelsmes statusu, tiek piemērots noteikums, kas nosaka maksimālo vērtību visiem izmantotajiem neizcelsmes materiāliem, tad visu ieinteresētās puses teritorijā

izmantoto materiālu kopējā vērtība, pieskaitot kopējo ārpus Kopienas vai Latvijas iegūto pievienoto vērtību, piemērojot šī panta noteikumus, nepārsniegs noteikto procentuālo lielumu.

5. 3. un 4. paragrāfa noteikumu piemērošanas nolūkā "kopējā pievienotā vērtība" nozīmē visas izmaksas, kas rodas ārpus Kopienas vai Latvijas, ieskaitot tur izmantoto materiālu vērtību.

6. 3. un 4. paragrāfa noteikumi neattiecas uz produktiem, kuri neatbilst II Pielikuma sarakstā dotajiem nosacījumiem vai kuri var tikt uzskatīti kā pietiekami apstrādāti vai pārstrādāti tikai tad, ja tiek pielietoti 6(2). pantā aprakstītie vispārīgie noteikumi.

7. 3. un 4. paragrāfa noteikumi neatteicas uz produktiem, kuri tiek aprakstīti Harmonizētās Sistēmas 50 līdz 63. grupā.

8. Jebkura veida apstrāde vai pārstrāde, kas ietverta šī panta noteikumos un kas veikta ārpus Kopienas vai Latvijas, tiks veikta saskaņā ar līgumiem par izvešanu uz pārstrādi vai līdzīgiem līgumiem."

4) 13., 14., 15., 17., 21., 27., 30. un 32. pantā vārdi "...4. pantā..." tiks aizvietoti ar "...3. un 4. pantā...";

5) 15. (6) panta pēdējā paragrāfā datums "1998. gada 31. decembrim" tiks aizvietots ar "2000. gada 31. decembrim";

6) 26(1). pantā termini "C2/CP3" tiks aizvietoti ar "CN22/CN23";

7) I Pielikuma 5.2. Piezīmē:

(a) starp uzskaitījumu

"-mākslīgie pavedieni" un

"-sintētiskās štāpeļšķiedras no polipropilēna"

tiks ievietots sekojošais:

"–strāvu vadoši pavedieni"

THE ASSOCIATION COUNCIL,

Having regard to the Europe Agreement establishing an association between the European Communities and their Member States, of the one part, and the Republic of Latvia, of the other part (), signed in Brussels on 12 June 1995, and in particular Article 38 of Protocol 3 () thereof,

Whereas the definition of the term "originating products" in Protocol 3 needs to be amended to ensure the proper operation of the extended system of cumulation which permits the use of materials originating in the European Community, Poland, Hungary, the Czech Republic, the Slovak Republic, Bulgaria, Romania, Latvia, Lithuania, Estonia, Slovenia, the European Economic Area (hereinafter referred to as "the EEA"), Iceland, Norway and Switzerland;

Whereas it would seem advisable to maintain in operation until 31 December 2000 the system of flat rate charges provided for in Article 15 of Protocol 3 in connection with the prohibition of drawback and exemption from customs duty;

Whereas, in view of the particular arrangements on industrial products obtaining between the Community and Turkey, it would also be appropriate to extend the cumulation system to such products originating in Turkey;

Whereas to facilitate trade and simplify administrative tasks it is desirable to amend the wording of Articles 3, 4 and 12 of Protocol 3;

Whereas, to take account of changes in processing techniques and shortages of certain raw materials, some corrections must be made to the list of working and processing requirements which non-originating materials have to fulfil to qualify for originating status,

HAS DECIDED AS FOLLOWS:

Article 1

 

Protocol 3 concerning the definition of the concept of "originating products" and methods of administrative cooperation is hereby amended as follows:

  1. Article 1 (i) shall be replaced by:

  1. "added value” shall be taken to be the ex-works price minus the customs value of each of the materials incorporated which originate in the other countries referred to in Articles 3 and 4 or, where the customs value is not known or cannot be ascertained, the first price verifiably paid for the products in the Community or Latvia. “;
  1. Articles 3 and 4 shall be replaced by the following:

"Article 3

Cumulation in the European Community

1. Without prejudice to the provisions of Article 2(1) products shall be considered as originating in the Community if such products are obtained there, incorporating materials originating in the Community, Bulgaria, Poland, Hungary, the Czech Republic, the Slovak Republic, Romania, Lithuania, Latvia, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein (*)) or Turkey (**) in accordance with the provisions of the Protocol on rules of origin annexed to the Agreements between the Community and each of these countries, provided that the working or processing carried out in the Community goes beyond that referred to in Article 7 of this Protocol. It shall not be necessary that such materials have undergone sufficient working or processlic, the Slovak Republic, Romania, Lithuania, Latvia, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein (*)) or Turkey (**) in accordance with the provision s of the Protocol on rules of origin annexed to the Agreements between the Community and each of these countries, provided that the working or processing carried out in the Community goes beyond that referred to in Article 7 of this Protocol. It shall not be necessary that such materials have undergone sufficient working or processlic, the Slovak Republic, Romania, Lithuania, Latvia, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein (*)) or Turkey (**) in accordance with the provisions of the Protocol on rules of origin annexed to the Agreements between the Communityn provided for in this Article may only be applied to materials and products which have acquired originating status by an application of rules of origin identical to those given in this Protocol.

The Community shall provide Latvia, through the Commission of the European Communities, with details of the Agreements and their corresponding rules of origin, which are applied with the other countries referred to in paragraph 1. The Commission of the European Communities shall publish in the Official Journal of the European Communities (C Series) the date on which the cumulation, provided for in this Article may be applied by those countries listed in paragraph 1 which have fulfilled the necessary requirements.

 

Article 4

Cumulation in Latvia

1. Without prejudice to the provision of Article 2(2), products shall be considered as originating in Latvia if such products are obtained there, incorporating materials originating in the Community, Bulgaria, Poland, Hungary, the Czech Republic, the Slovak Republic, Romania, Lithuania, Latvia, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein) or Turkey (**) in accordance with the provisions of the Protocol on rules of origin annexed to the Agreements between Latvia and each of these countries, provided that the working or processing carried out in Latvia goes beyond that referred to in Article 7 of this Protocol. It shall not be necessary that such materials have undergone sufficient working or processing.

2. Where the working or processing carried out in Latvia does not go beyond the operations referred to in Article 7, the product obtained shall be considered as originating in Latvia only where the value added there is greater than the value of the materials used originating in any one of the other countries referred to in paragraph 1. If this is not so, the product obtained shall be considered as originating in the country which accounts for the highest value of originating materials used in the manufacture in Latvia.

3. Products, originating in one of the countries referred to in paragraph 1, which do not undergo any working or processing in Latvia, retain their origin if exported into one of these countries.

4. The cumulation provided for in this Article may only be applied to materials and products which have acquired originating status by an application of rules of origin identical to those given in this Protocol.

Latvia shall provide the Community, through the Commission of the European Communities, with details of the Agreements and their corresponding rules of origin, which are applied with the other countries referred to in paragraph l. The Commission of the European Communities shall publish in the Official Journal of the European Communities (C Series) the date on which the cumulation, provided for in this Article, may be applied by those countries listed in paragraph 1 which have fulfilled the necessary requirements.

  1. Article 12 shall be replaced by the following:

"Article 12

Principle of territoriality

1. Except as provided for in Article 2(1)(c), Articles 3 and 4 and paragraph 3 of this Article, the conditions for acquiring originating status set out in Title II must continue to be fulfilled at all times in the Community or Latvia.

2. Except as provided for in Articles 3 and 4, where originating goods exported from the Community or Latvia to another country return, they must be considered as non-originating, unless it can be demonstrated to the satisfaction of the customs authorities that:

  1. the returning goods are the same as those that were exported; and
  2. they have not undergone any operation beyond that necessary to preserve them in good condition while in that country or while being exported.

3. The acquisition of originating status in accordance with the conditions set out in Title II shall not be affected by working or processing done outside the Community or Latvia on materials exported from the Community or Latvia and subsequently reimported there, provided:

  1. the said materials are wholly obtained in the Community or Latvia or have undergone working or processing beyond the insufficient operations listed in Article 7 prior to being exported; and

  1. it can be demonstrated to the satisfaction of the customs authorities that:

    1. the reimported goods have been obtained by working or processing the exported materials; and

    1. the total added value acquired outside the Community or Latvia by applying the provisions of this Article does not exceed 10% of the ex-works price of the end product for which originating status is claimed.

4. For the purposes of paragraph 3, the conditions for acquiring originating status set out in Title II shall not apply to working or processing done outside the Community or Latvia. But where, in the list in Annex II, a rule setting a maximum value for all the non-originating materials incorporated is applied in determining the originating status of the end product, the total value of the non-originating materials incorporated in the territory of the party concerned, taken together with the total added value acquired outside the Community or Latvia by applying the provisions of this Article, shall not exceed the stated percentage.

5. For the purposes of applying the provisions of paragraph 3 and 4, "total added value" shall be taken to mean all costs arising outside the Community or Latvia, including the value of the materials incorporated there.

6. The provisions of paragraphs 3 and 4 shall not apply to products which do not fulfil the conditions set out in the list in Annex II or which can be considered sufficiently worked or processed only if the general values fixed in Article 6(2) are applied.

7. The provisions of paragraphs 3 and 4 shall not apply to products coming under Chapters 50 to 63 of the Harmonised System.

8. Any working or processing of the kind covered by the provisions of this Article and done outside the Community or Latvia shall be done under the outward processing arrangements, or similar arrangements.";

  1. in Articles 13, 14, 15, 17, 21, 27, 30 and 32, the phrase "referred to in Article 4" shall be replaced by "referred to in Articles 3 and 4";

in the last paragraph of Article 15(6), the date "31 December 1998" shall be replaced by " 31 December 2000 ";

in Article 26(1), the terms "C2/CP3" shall be replaced by "CN22/CN23";

in Annex 1, Note 5.2:
