Par Latvijas Republikas valdības un Marokas Karalistes valdības

divpusējo nolīgumu par gaisa transportu

1.pants. 1999.gada 19.maijā Varšavā parakstītais Latvijas Republikas valdības un Marokas Karalistes valdības divpusējais nolīgums par gaisa transportu (turpmāk - Nolīgums) un tā Pielikums (turpmāk - Pielikums) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu ir izsludināms Nolīgums un Pielikums latviešu un angļu valodā.

3.pants. Latvijas Republikas Ārlietu ministrija saskaņā ar Nolīguma 22.pantu reģistrē Nolīgumu un Pielikumu Starptautiskajā civilās aviācijas organizācijā.

4.pants. Nolīgums un Pielikums stājas spēkā tā 23.pantā noteiktajā laikā un kārtībā, un par to Ārlietu ministrija paziņo laikrakstā "Latvijas Vēstnesis".

DIVPUSĒJS NOLĪGUMS

par gaisa transportu

 

Latvijas Republikas valdība un Marokas Karalistes valdība (turpmāk - "Līgumslēdzējām Pusēm"),

būdamas Konvencijas par starptautisko civilo aviāciju, kas atklāta parakstīšanai Čikāgā 1944.gada 7.decembrī, dalībnieces un

vēloties noslēgt nolīgumu, lai izveidotu un attīstītu gaisa satiksmi starp abu valstu teritorijām un aiz to robežām,

ir vienojušās par:

1.pants

DEFINĪCIJAS

1. Šajā Nolīgumā, ja kontekstā nav paredzēts citādi:

a) termins "Konvencija" nozīmē Konvenciju par starptautisko civilo aviāciju, kas atklāta parakstīšanai Čikāgā 1944.gada 7.decembrī un ietver katru pielikumu, kas pieņemts saskaņā ar Konvencijas 90.pantu un katru Konvencijas grozījumu, kas izdarīts saskaņā ar 94.pantu, ciktāl šos pielikumus un grozījumus ir ratificējušas vai apstiprinājušas abas Līgumslēdzējas Puses;

b) termins "Nolīgums" nozīmē šo Nolīgumu, tā Pielikumu un katru grozījumu, kas tajos izdarīts;

c) termins "aviācijas institūcijas" attiecībā uz Latvijas Republikas valdību nozīmē Satiksmes ministriju, attiecībā uz Marokas Karalistes valdību - Civilās aviācijas ministru un abos gadījumos - jebkuru personu vai institūciju, kas pilnvarota veikt civilās aviācijas vai līdzīgas funkcijas;

d) termins "Nolīgumā paredzētā satiksme" nozīmē gaisa satiksmi, kuru noteiktajos maršrutos veic saskaņā ar šā Nolīguma 2.panta 1.punktu;

e) terminiem "gaisa satiksme", "starptautiskā gaisa satiksme", "aviokompānija" un "apstāšanās nekomerciālos nolūkos" ir Konvencijas 96.pantā attiecīgi noteiktā nozīme;

f) termins "gaisa kuģa aprīkojums" nozīmē priekšmetus, kuri nav pārvietojami gaisa kuģa krājumi un rezerves daļas, bet kurus izmanto gaisa kuģī lidojuma laikā, tajā skaitā pirmās palīdzības un avārijas piederumus;

g) termins "nozīmētās aviokompānijas" nozīmē vienu vai vairākas aviokompānijas, kuras saskaņā ar šā Nolīguma 3.pantu (Aviokompāniju nozīmēšana) nozīmējusi viena Līgumslēdzēja Puse un kurām saskaņā ar minēto pantu otra Līgumslēdzēja Puse izsniegusi pārvadājumu atļauju;

h) termins "rezerves daļas" nozīmē remontam vai aizvietošanai nepieciešamos priekšmetus, kuri paredzēti ievietošanai gaisa kuģī, tajā skaitā dzinējus un propellerus;

i) termins "noteiktie maršruti" nozīmē maršrutus, kas noteikti šā Nolīguma Pielikumā;

j) termins "krājumi" nozīmē viegli patērējamus priekšmetus, kas paredzēti izmantošanai vai pārdošanai gaisa kuģī lidojuma laikā, tajā skaitā intendanta krājumus;

k) termins "tarifi" nozīmē cenas, kuras maksā par pasažieru, bagāžas, kravas pārvadāšanu un apstākļus, par kādiem šīs cenas tiek piemērotas, ieskaitot aģentu un citu palīgpakalpojumu cenas, komisijas naudu un apstākļus, bet izņemot atlīdzību par pasta pārvadāšanu un tās apstākļus;

l) termins "teritorija" attiecībā uz valsti nozīmē šīs valsts suverenitātē esošo sauszemes teritoriju, iekšējos ūdeņus un pieguļošās teritoriālās jūras.

 

2.pants

TIESĪBU PIEŠĶIRŠANA

1. Katra Līgumslēdzēja Puse piešķir otrai Līgumslēdzējai Pusei tiesības izveidot gaisa satiksmi maršrutos, kas noteikti Pielikuma attiecīgajā iedaļā.

2. Lai Līgumslēdzēja Puse varētu veikt regulāru starptautisko gaisa satiksmi, otra Līgumslēdzēja Puse piešķir tai šādas tiesības:

a) bez nosēšanās lidot pāri otras Līgumslēdzējas Puses valsts teritorijai;

b) apstāties tās valsts teritorijā nekomerciālos nolūkos; un

c) apstāties minētās valsts teritorijā punktos, kas šim maršrutam noteikti šā Nolīguma Pielikumā, lai saskaņā ar šā Nolīguma noteikumiem izsēdinātu un uzņemtu starptautiskās satiksmes pasažierus, izkrautu un iekrautu kravu un pastu.

3. Nekas šajā pantā nenozīmē, ka vienas Līgumslēdzējas Puses nozīmētajai aviokompānijai (aviokompānijām) ir tiesības otras Līgumslēdzējas Puses valsts teritorijā uzņemt pasažierus, kravu un pastu, lai tos pārvadātu uz citu punktu tās pašas Līgumslēdzējas Puses valsts teritorijā.

3.pants

AVIOKOMPĀNIJU NOZĪMĒŠANA

1. Lai veiktu Nolīgumā paredzēto satiksmi noteiktajos maršrutos, katrai Līgumslēdzējai Pusei ir tiesības rakstiski nozīmēt otrai Līgumslēdzējai Pusei vienu vai vairākas aviokompānijas.

2. Pēc paziņojuma par nozīmēšanu saņemšanas otras Līgumslēdzējas Puses aviācijas institūcijas saskaņā ar šā panta un 4.panta noteikumiem bez kavēšanās izsniedz aviokompānijai (aviokompānijām), kas nozīmēta saskaņā ar šā panta 1.punktu, attiecīgu pārvadājumu atļauju.

3. Lai saskaņā ar šā panta 2.punktu izsniegtu attiecīgu pārvadājumu atļauju, vienas Līgumslēdzējas Puses aviācijas institūcijas var pieprasīt otras Līgumslēdzējas Puses nozīmētajai aviokompānijai (aviokompānijām) pierādījumus, ka tās spēj pildīt likumus un normatīvos aktus, kurus saskaņā ar Konvencijas prasībām minētās institūcijas parasti piemēro starptautiskajai gaisa satiksmei.

4. Aviokompānija, kas nozīmēta un pilnvarota saskaņā ar šo pantu, var uzsākt veikt Nolīgumā paredzēto satiksmi, ja saskaņā ar šā Nolīguma 5.panta (Sarakstu apstiprināšana) un 10.panta (Tarifi) noteikumiem šiem pārvadājumiem ir noteikti un stājušies spēkā tarifi, kurus nozīmētā aviokompānija (aviokompānijas) ievēro.

 

4.pants

PĀRVADĀJUMU ATĻAUJAS ANULĒŠANA VAI APTURĒŠANA

1. Katrai Līgumslēdzējai Pusei ir tiesības anulēt pārvadājumu atļauju vai apturēt tiesību izmantošanu, kuras otras Līgumslēdzējas Puses nozīmētajai aviokompānijai (aviokompānijām) piešķirtas saskaņā ar šā Nolīguma 3.pantu, vai arī pieprasīt, lai tiktu izpildīti ar šo tiesību izmantošanu saistīti nosacījumi, ja:

a) minētā nozīmētā aviokompānija nevar pierādīt, ka spēj pildīt likumu un normatīvo aktu prasības, kuras šīs institūcijas parasti saskaņā ar Konvenciju piemēro starptautiskajai gaisa satiksmei; vai

b) minētā aviokompānija nespēj veikt satiksmi saskaņā ar šā Nolīguma noteikumiem; vai

c) nozīmētā aviokompānija nespēj pildīt minētās tiesības piešķīrušās Līgumslēdzējas Puses valsts teritorijā spēkā esošos likumus vai normatīvos aktus; vai

d) minētā aviokompānija nevar pierādīt, ka reālās īpašuma tiesības uz to un tās efektīvā kontrole ir aviokompāniju nozīmējušajai Līgumslēdzējai Pusei vai tās pilsoņiem.

2. Ja nav nepieciešama nekavējoša šā panta 1.punktā paredzētā pārvadājumu atļaujas anulēšana, apturēšana vai saistību izpildes pieprasīšana, lai novērstu turpmāku likumu un normatīvo aktu vai šā Nolīguma noteikumu pārkāpšanu, šīs izmanto tikai pēc konsultācijām ar otras Līgumslēdzējas Puses aviācijas institūcijām, kuras veic saskaņā ar šā Nolīguma 17.pantu.

5.pants

LIDOJUMU SARAKSTU APSTIPRINĀŠANA

1. Vienas Līgumslēdzējas Puses nozīmētā aviokompānija (aviokompānijas) ne vēlāk kā trīsdesmit (30) dienas pirms Nolīgumā paredzētās satiksmes uzsākšanas iesniedz otras Līgumslēdzējas Puses aviācijas institūcijām apstiprināšanai paredzamos lidojumu sarakstus.

Šajos lidojumu sarakstos iekļauj ziņas par pakalpojumu veidu un izmantojamo gaisa kuģi, kā arī lidojumu sarakstu, tarifus, pārvadājumu noteikumus un citu attiecīgu informāciju.

2. Ja nozīmētā aviokompānija (aviokompānijas) līdztekus apstiprinātajā sarakstā noteiktajiem vēlas veikt papildu lidojumus, tā vispirms saņem attiecīgās Līgumslēdzējas Puses aviācijas institūciju atļauju.

3. Ja nozīmētā aviokompānija (aviokompānijas) pēc tam vēlas izdarīt grozījumus apstiprinātajos sarakstos, tā šos grozījumus iesniedz apstiprināšani otras Līgumslēdzējas Puses aviācijas institūcijām.

6.pants

NOLĪGUMĀ PAREDZĒTĀS SATIKSMES VEIKŠANAS PRINCIPI

1. Abu Līgumslēdzēju Pušu nozīmētajām aviokompānijām ir taisnīgas un vienlīdzīgas iespējas veikt Nolīgumā paredzēto satiksmi. Tomēr, veicot Nolīgumā paredzēto satiksmi, katra nozīmētā aviokompānija ņem vērā otras nozīmētās aviokompānijas intereses, lai nenodarītu kaitējumu tās veiktajai satiksmei.

2. Trešās un ceturtās gaisa brīvības tiesību īstenošana, veicot lidojumus noteiktajos maršrutos starp abu Līgumslēdzēju Pušu valstu teritorijām abos virzienos, veido katras Līgumslēdzējas Puses pamattiesības.

3. Lai veiktu Nolīgumā paredzēto satiksmi:

a) kopīgo kapacitāti, kuru nodrošina noteiktajā maršrutā, nosaka tādā apjomā, lai apmierinātu esošo un saprātīgi paredzamo pieprasījumu pēc pārvadājumiem;

b) abu Līgumslēdzēju Pušu nozīmētās aviokompānijas šā panta ‘‘a’’ punktā minēto kapacitāti dala vienādās daļās.

4. Lai apmierinātu sezonas rakstura pieprasījuma pēc satiksmes svārstības vai neparedzētu īslaicīgu pieprasījumu pēc satiksmes, abu Līgumslēdzēju Pušu nozīmētās aviokompānijas konsultējas par attiecīgajā situācijā piemērotu pasākumu veikšanu. Katru aviokompāniju vienošanos, kas noslēgta par minēto jautājumu, kā arī šīs vienošanās grozījumus iesniedz apstiprināšanai abu Līgumslēdzēju Pušu aviācijas institūcijām.

5. Ja viena Līgumslēdzēja Puse nevēlas veikt satiksmi vienā vai vairākos maršrutos, tā vienojas ar otru Līgumslēdzēju Pusi par daļas vai visas transporta kapacitātes, no kuras tā atsakās, nodošanu uz noteiktu laika posmu šai otrajai Līgumslēdzējai Pusei.

Līgumslēdzēja Puse, kura visas tiesības vai to daļu nodevusi otrai Līgumslēdzējai Pusei, pēc minētā laika posma beigām var tās saņemt atpakaļ.

 

7.pants

LIKUMU UN NORMATĪVO AKTU PIEMĒROŠANA

1. Vienas Līgumslēdzējas Puses likumus un normatīvos aktus, kuri regulē tās nozīmētās aviokompānijas (aviokompāniju) starptautiskās gaisa satiksmes gaisa kuģa ierašanos tās valsts teritorijā, lidojumus tajā vai tās atstāšanu,vai arī šā gaisa kuģa satiksmi un navigāciju minētajā teritorijā, piemēro otras Līgumslēdzējas Puses nozīmētās aviokompānijas (aviokompāniju) gaisa kuģim un šis gaisa kuģis tos ievēro, ierodoties minētās Līgumslēdzējas Puses valsts teritorijā, to atstājot vai uzturoties tajā.

2. Vienas Līgumslēdzējas Puses likumus un normatīvos aktus, kuri regulē pasažieru, bagāžas, apkalpes, kravas vai pasta ierašanos tās valsts teritorijā, uzturēšanos tajā vai tās atstāšanu, tajā skaitā likumus un normatīvos aktus, kuri regulē ieceļošanu, aizceļošanu, emigrāciju, imigrāciju, pases, kā arī muitas un veselības vai sanitāros pasākumus, piemēro otras Līgumslēdzējas Puses nozīmētās aviokompānijas (aviokompāniju) gaisa kuģa pārvadātajiem pasažieriem, bagāžai, apkalpei, kravai un pastam, tiem ierodoties minētās Līgumslēdzējas Puses valsts teritorijā, to atstājot vai uzturoties tajā. Šos likumus un normatīvos aktus piemēro vienas Līgumslēdzējas Puses nozīmētajai aviokompānijai (aviokompānijām) tieši tāpat kā otras Līgumslēdzējas Puses nozīmētajai aviokompānijai (aviokompānijām).

 

8.pants

LIDOSTU, IEKĀRTU UN PAKALPOJUMU LIETOTĀJU MAKSĀJUMI

Vienas Līgumslēdzējas Puses nozīmētās aviokompānijas gaisa kuģis, kas izmanto otras Līgumslēdzējas Puses lidostu un citu iekārtu pakalpojumus, par tiem maksā tāda paša apjoma maksu kā šīs otras Līgumslēdzējas Puses regulārās starptautiskās gaisa satiksmes gaisa kuģis.

 

9.pants

AVIOKOMPĀNIJU PĀRSTĀVNIECĪBA

1. Katra Līgumslēdzēja Puse uz savstarpējiem noteikumiem savas valsts teritorijā otras Līgumslēdzējas Puses nozīmētajai aviokompānijai (aviokompānijām) piešķir tiesības izveidot pārstāvniecību, kurā tā nodarbina tehnisko, administratīvo un komerciālo personālu, kas nepieciešams satiksmes veikšanas nodrošināšanai.

2. Lai nodrošinātu savu pakalpojumu sniegšanu, nozīmētajai aviokompānijai (aviokompānijām) saskaņā ar otras Līgumslēdzējas Puses valstī spēkā esošajiem likumiem un normatīvajiem aktiem ir tiesības nodarbināt savu tehnisko, administratīvo un komerciālo personālu, kuru veido tās valsts pilsoņi.

10.pants

TARIFI

1. Tarifus, kurus vienas Līgumslēdzējas Puses aviokompānija (aviokompānijas) nosaka par pārvadājumiem uz vai no otras Līgumslēdzējas Puses valsts teritorijas, nosaka pieņemamā līmenī, pienācīgu uzmanību veltot visiem attiecīgajiem faktoriem, tajā skaitā pārvadājumu izmaksām, mērenai peļņai un citu aviokompāniju tarifiem.

2. Par šā panta 1.punktā minētajiem tarifiem, ja iespējams, pēc konsultācijām ar citām aviokompānijām, kas veic satiksmi maršrutā vai tā posmā, vienojas abu Līgumslēdzēju Pušu nozīmētās aviokompānijas, un šo vienošanos, ciktāl tas iespējams, panāk, izmantojot Starptautiskās gaisa transporta asociācijas tarifu aprēķināšanas procedūras.

3. Tarifus, par kuriem panākta vienošanās, iesniedz apstiprināšanai abu Līgumslēdzēju Pušu aviācijas institūcijām ne vēlāk kā trīsdesmit (30) dienas pirms to paredzētās ieviešanas dienas (turpmāk dēvēts par ‘‘paziņošanas periodu’’). Īpašos gadījumos pēc minēto institūciju vienošanās paziņošanas periodu var samazināt.

4. Šā panta 3.punktā minētā apstiprināšana notiek saprotami. Ja neviena aviācijas institūcija nav paziņojusi par tarifu noraidīšanu trīsdesmit (30) dienu laikā pēc to iesniegšanas saskaņā ar 3.punktu, tarifus uzskata par apstiprinātiem. Ja paziņošanas periods samazināts saskaņā ar 3.punktu, aviācijas institūcijas var vienoties, ka periods, kurā jāpaziņo par tarifu noraidīšanu, ir mazāks par trīsdesmit (30) dienām.

5. Ja aviācijas institūcijas nespēj vienoties par kādu tarifu, kas tām iesniegts saskaņā ar 3.punktu vai par kāda tarifa noteikšanu saskaņā ar 4.punktu, strīdu izšķir saskaņā ar šā Nolīguma 20.panta (Strīdu izšķiršana) noteikumiem.

6. Tarifs, kas noteikts saskaņā ar šā panta noteikumiem, ir spēkā līdz jauna tarifa noteikšanai. Tomēr tarifa termiņu saskaņā ar šo punktu nevar pagarināt:

a) vairāk nekā divpadsmit (12) mēnešus pēc tā termiņa beigām un;

b) ja nav noteikta šā termiņa beigu diena, vairāk nekā divpadsmit (12) mēnešus pēc dienas, kurā vienas Līgumslēdzējas Puses nozīmētā aviokompānija (aviokompānijas) Līgumslēdzēju Pušu aviācijas institūcijām saskaņā ar šā Nolīguma noteikumiem rakstiski paziņo jauno tarifu.

7. Katra Līgumslēdzēja Puse nodrošina, ka visas aviokompānijas, kas veic pārvadājumus uz tās valsts teritoriju un no tās, stingri ievēro tarifus, kuri apstiprināti saskaņā ar šā panta noteikumiem.

 

11.pants

APMAIŅA AR STATISTIKAS INFORMĀCIJU

Katras Līgumslēdzējas Puses aviācijas institūcijas pēc otras Līgumslēdzējas Puses aviācijas institūciju rakstiska pieprasījuma sniedz tām informāciju par Nolīgumā paredzēto satiksmi, kuru veic attiecīgā nozīmētā aviokompānija (aviokompānijas). Šī informācija ietver statistikas datus un citu informāciju, kura ir nepieciešama, lai noteiktu šo aviokompāniju veiktās Nolīgumā paredzētās satiksmes apjomu.

 

12.pants

SERTIFIKĀTU UN LICENČU ATZĪŠANA

Lidojumu drošības sertifikātus, kvalifikācijas sertifikātus un licences, kuras izsniegusi vai atzinusi par derīgām viena Līgumslēdzēja Puse un kuras joprojām ir spēkā, otra Līgumslēdzēja Puse atzīst par derīgām, lai saskaņā ar šo Nolīgumu veiktu satiksmi noteiktajos maršrutos un sniegtu pakalpojumus, ja prasības, saskaņā ar kurām minētie sertifikāti vai licences izsniegtas vai atzītas par derīgām, atbilst standartiem, kas noteikti vai var tikt noteikti Konvencijā, vai nav zemāki par tajā noteiktajiem minimālajiem standartiem.

Katra Līgumslēdzēja Puse tomēr saglabā tiesības neatzīt par derīgiem lidojumiem pāri savas valsts teritorijai kvalifikācijas sertifikātus un licences, kuras tās valsts pilsoņiem izsniegusi vai atzinusi par derīgām otra Līgumslēdzēja Puse vai kāda cita valsts.

 

13.pants

AVIĀCIJAS DROŠĪBA

1. Saskaņā ar savām tiesībām un pienākumiem, kas izriet no starptautiskajām tiesībām, Līgumslēdzējas Puses apliecina, ka to saistības vienai pret otru aizsargāt civilās aviācijas drošību pret nelikumīgu iejaukšanos veido šā Nolīguma neatņemamu sastāvdaļu. Neierobežojot savu tiesību un pienākumu vispārējo raksturu, kas izriet no starptautiskajām tiesībām, Līgumslēdzējas Puses darbojas saskaņā ar Konvenciju par noziegumiem un dažām citām darbībām, kas izdarītas gaisa kuģos, kura parakstīta Tokijā 1963.gada 14.septembrī, Konvenciju par cīņu pret nelikumīgu gaisa kuģu sagrābšanu, kura parakstīta Hāgā 1970.gada 16.decembrī, Konvenciju par cīņu pret nelikumīgām darbībām, kas apdraud civilās aviācijas drošību, kura parakstīta Monreālā 1971.gada 23.septembrī un Protokolu par cīņu pret nelikumīgu vardarbību lidostās, kas apkalpo starptautisko civilo aviāciju, kas parakstīts Monreālā 1988.gada 24.februārī, kā arī citiem daudzpusējiem nolīgumiem par civilās aviācijas drošību, kas kļuvuši saistoši abām Līgumslēdzējām Pusēm.

2. Līgumslēdzējas Puses pēc pieprasījuma sniedz viena otrai visu nepieciešamo palīdzību, lai novērstu civilo gaisa kuģu nelikumīgu sagrābšanu un citas nelikumīgas darbības, kas apdraud gaisa kuģu, to pasažieru un apkalpju, lidostu un aeronavigācijas iekārtu drošību, kā arī citus draudus civilās aviācijas drošībai.

3. Līgumslēdzējas Puses savstarpējās attiecībās rīkojas saskaņā ar aviācijas drošības noteikumiem, kurus noteikusi Starptautiskā civilās aviācijas organizācija un kuri iekļauti Konvencijas par starptautisko civilo aviāciju pielikumos; tās pieprasa, lai to reģistrā reģistrēto gaisa kuģu ekspluatanti vai gaisa kuģu ekspluatanti, kuru pamatdarbības vieta un pastāvīgā mītne ir to valstu teritorijās, kā arī to valstu teritorijās esošo lidostu ekspluatanti darbotos saskaņā ar minētajiem aviācijas drošības noteikumiem.

4. Katra Līgumslēdzēja Puse piekrīt, ka šiem gaisa kuģu ekspluatantiem var pieprasīt ievērot 3.punktā minētos aviācijas drošības noteikumus, kurus otra Līgumslēdzēja Puse pieprasa ievērot, ierodoties tās valsts teritorijā, to atstājot vai uzturoties tajā. Katra Līgumslēdzēja Puse nodrošina, ka tās valsts teritorijā efektīvi tiek veikti pienācīgi pasākumi, lai aizsargātu gaisa kuģi un pirms iekāpšanas vai iekraušanas vai arī tās laikā pārbaudītu pasažierus apkalpi, pasažieriem klātesošo bagāžu, bagāžu, kravu un gaisa kuģa krājumus. Katra Līgumslēdzēja Puse labvēlīgi uztver jebkuru otras Līgumslēdzējas Puses lūgumu veikt piemērotus īpašus drošības pasākumus, lai novērstu konkrētus draudus.

5. Ja noticis nelikumīgas civilā gaisa kuģa sagrābšanas incidents vai ir tā draudi, vai arī veiktas citas nelikumīgas darbības, kas apdraud šā gaisa kuģa, tā pasažieru un apkalpes, lidostu un aeronavigācijas iekārtu drošību, Līgumslēdzējas Puses palīdz viena otrai, atvieglojot sazināšanos un veicot citus attiecīgus pasākumus, lai ātri un droši novērstu minēto incidentu vai tā draudus.

 

14.pants

ATBRĪVOŠANA NO MUITAS NODEVĀM, PĀRBAUDES MAKSĀJUMIEM UN CITIEM LĪDZĪGIEM MAKSĀJUMIEM

1. Gaisa kuģis, kuru Līgumslēdzējas Puses nozīmētā aviokompānija (aviokompānijas) izmanto Nolīgumā paredzētās satiksmes veikšanai, šā gaisa kuģa aprīkojums, degvielas un smērvielu krājumi, kā arī pārējie tā krājumi (tajā skaitā ēdieni, dzērieni un tabakas izstrādājumi), kas atrodas gaisa kuģī, ir atbrīvoti no visām muitas nodevām, pārbaudes maksājumiem un citiem līdzīgiem maksājumiem šim gaisa kuģim ierodoties otras Līgumslēdzējas Puses valsts teritorijā, ja minētais aprīkojums un krājumi paliek gaisa kuģī līdz to aizvešanai vai izmantošanai lidojuma laikā ceļa posmā pāri šīs valsts teritorijai.

2. Saskaņā ar šā panta 3.punktu no muitas nodevām, pārbaudes maksājumiem un līdzīgiem maksājumiem, izņemot maksu par palīgpakalpojumiem, atbrīvo:

a) gaisa kuģa krājumus, kuri vienas Līgumslēdzējas Puses valsts teritorijā šīs Līgumslēdzējas Puses aviācijas institūciju noteiktajos apjomos uzņemti otras Līgumslēdzējas Puses gaisa kuģī, kas veic Nolīgumā paredzēto satiksmi, lai tos izmantotu, aizlidojot no minētās Līgumslēdzējas Puses valsts teritorijas;

b) rezerves daļas, kas ievestas vienas Līgumslēdzējas Puses valsts teritorijā, lai tās izmantotu otras Līgumslēdzējas Puses nozīmētās aviokompānijas (aviokompāniju) gaisa kuģa, kas veic Nolīgumā paredzēto satiksmi, tehniskajai apkopei vai remontam;

c) degvielu un smērvielas, kas piegādātas vienas Līgumslēdzējas Puses nozīmētās aviokompānijas (aviokompāniju) gaisa kuģim, kas veic Nolīgumā paredzēto satiksmi, šim gaisa kuģim ierodoties otras Līgumslēdzējas Puses valsts teritorijā, lidojot tranzītā vai atstājot šo teritoriju, pat ja minētos krājumus izmanto lidojuma posmā pāri tās Līgumslēdzējas Puses valsts teritorijai, kurā tie uzņemti gaisa kuģī.

3. Materiālus, kas minēti 2.punkta “a”, “b” un “c” apakšpunktos, var nodot abu Līgumslēdzēju Pušu muitas uzraudzībā vai kontrolē.

4. Tiešā tranzīta bagāža un krava ir atbrīvota no muitas nodevām un citiem līdzīgiem nodokļiem, ja tā atrodas muitas uzraudzībā vai kontrolē.

5. Parasto gaisa kuģa aprīkojumu, kā arī materiālus un krājumus, kuri atrodas vienas Līgumslēdzējas Puses nozīmētās aviokompānijas (aviokompāniju) gaisa kuģī, otras Līgumslēdzējas Puses valsts teritorijā var izkraut tikai pēc tās muitas institūciju atļaujas un minētās muitas institūcijas var pieprasīt, lai šo aprīkojumu, materiālus un krājumus izvietotu šo institūciju uzraudzībā līdz to aizvešanai vai citādai izvietošanai saskaņā ar muitas likumiem un normatīvajiem aktiem.

 

15.pants

TIRDZNIECĪBA, IEŅĒMUMI UN IENĀKUMU PĀRSŪTĪŠANA

1. Katrai nozīmētajai aviokompānijai otras Līgumslēdzējas Puses valsts teritorijā ir tiesības pašai vai ar aģentu starpniecību uzsākt gaisa transporta biļešu pārdošanu. Šo pārdošanu veic par attiecīgās valsts valūtu.

2. Katra Līgumslēdzēja Puse piešķir otras Līgumslēdzējas Puses nozīmētajai aviokompānijai (aviokompānijām) tiesības brīvi pārsūtīt naudas summas, kas iegūtas sakarā ar pasažieru, bagāžas, kravas un pasta pārvadājumiem, kā arī citām ar gaisa transportu saistītām darbībām, kuras atļauj attiecīgās valsts normatīvie akti, šo darbību rezultātā ienākumiem pārsniedzot izdevumus. Minēto pārsūtīšanu veic, ņemot vērā valūtas maiņas kursu un saskaņā ar attiecīgiem valsts likumiem un normatīvajiem aktiem, kuri regulē maksājumus, bet ja nav noteikts oficiāls valūtas maiņas kurss, pārsūtīšanu veic, ņemot vērā dominējošo valūtas tirgus maiņas kursu konkrētiem maksājumiem.

3. Ja maksājumus starp abām Līgumslēdzējām Pusēm regulē īpašs līgums, piemēro šo līgumu.

 

16.pants

APLIKŠANA AR NODOKĻIEM

Ienākumus, kurus Līgumslēdzējas Puses nozīmētā aviokompānija ieguvusi par starptautiskajiem gaisa pārvadājumiem, apliek ar nodokļiem tikai tajā valstī, kurā atrodas nozīmētās aviokompānijas galvenā mītne.

 

17.pants

KONSULTĀCIJAS

1. Līgumslēdzēju Pušu aviācijas institūcijas ciešas sadarbības garā periodiski konsultējas, lai nodrošinātu šā Nolīguma un tā Pielikuma noteikumu izpildi un pienācīgu ievērošanu, kā arī konsultējas gadījumos, kad šajā Nolīgumā vai tā Pielikumā paredzēts izdarīt grozījumus.

2. Katra Līgumslēdzēja Puse var pieprasīt konsultācijas, kuras notiek sarunu vai arī sarakstes veidā.

Ja paredzētas sarunas, tās sākas trīsdesmit (30) dienu laikā pēc pieprasījuma, ja abas Līgumslēdzējas Puses nav vienojušās par šā perioda saīsināšanu.

 

18.pants

GROZĪJUMI

Visus šā Nolīguma grozījumus veic apmainoties ar notām un tie stājas spēkā dienā, kas noteikta apmainoties ar diplomātiskajām notām.

 

19.pants

DAUDZPUSĒJU KONVENCIJU PIEMĒROŠANA

Šo Nolīgumu var grozīt, lai tas atbilstu daudzpusējam līgumam, kas kļuvis saistošs abām Līgumslēdzējām Pusēm.

20.pants

STRĪDU IZŠĶIRŠANA

1. Ja Līgumslēdzējām Pusēm rodas strīds par šā Nolīguma iztulkošanu vai piemērošanu, Līgumslēdzējas Puses vispirms cenšas to atrisināt tiešu sarunu ceļā.

2. Ja Līgumslēdzējas Puses nespēj strīdu atrisināt tiešu sarunu ceļā, tās strīda izšķiršanu var uzticēt kādai trešās valsts personai vai kompetentai institūcijai.

3. Ja, izmantojot minētās metodes, strīds tomēr netiek izšķirts, strīdu pēc vienas Līgumslēdzējas Puses lūguma var iesniegt izšķiršanai šķīrējtiesā (turpmāk dēvēta par “Šķīrējtiesu”), kas sastāv no trīs tiesnešiem un kurai katra Līgumslēdzēja Puse ieceļ vienu tiesnesi, bet trešo tiesnesi ieceļ abi jau ieceltie tiesneši.

4. Katra Līgumslēdzēja Puse savu tiesnesi ieceļ sešdesmit (60) dienu laikā pēc tam, kad diplomātiskā ceļā saņēmusi otras Līgumslēdzējas Puses lūgumu par strīda izšķiršanu šķīrējtiesā, un trešo tiesnesi ieceļ nākamo sešdesmit (60) dienu laikā. Ja viena Līgumslēdzēja Puse savu tiesnesi neieceļ noteiktajā laika periodā vai ja trešais tiesnesis nav iecelts noteiktajā laika periodā, katra Līgumslēdzēja Puse var lūgt Starptautiskās civilās aviācijas organizācijas Padomes prezidentu iecelt nepieciešamo tiesnesi vai tiesnešus.

5. Trešais tiesnesis, kas iecelts saskaņā ar 3.punkta prasībām, ir trešās valsts pilsonis un pilda šķīrējtiesas priekšsēdētāja pienākumus.

6. Šķīrējtiesa pati nosaka savas darbības procedūru.

7. Saskaņā ar šķīrējtiesas galīgo lēmumu Līgumslēdzējas Puses šķīrējtiesas izdevumus sedz vienādās daļās.

8. Līgumslēdzējas Puses pilda visus šķīrējtiesas iepriekšējos lēmumus vai tās galīgo lēmumu.

9. Ja viena Līgumslēdzēja Puse nepilda un ciktāl tā nepilda šķīrējtiesas lēmumu, kas pieņemts saskaņā ar šo pantu, otra Līgumslēdzēja Puse var ierobežot, apturēt vai anulēt tiesības vai priekšrocības, kuras saskaņā ar šo Nolīgumu tā piešķīrusi minētajai Līgumslēdzējai Pusei.

 

21.pants

NOLĪGUMA IZBEIGŠANA

Katra Līgumslēdzēja Puse jebkurā laikā var rakstiski paziņot otrai Līgumslēdzējai Pusei par tās lēmumu pārtraukt šo Nolīgumu. Paziņojumu vienlaikus nosūta arī Starptautiskajai civilās aviācijas organizācijai. Šādā gadījumā Nolīgums tiek pārtraukts divpadsmit (12) mēnešus pēc tam, kad paziņojumu saņēmusi otra Līgumslēdzēja Puse, ja vien paziņojumu par Nolīguma pārtraukšanu pēc savstarpējas vienošanās neatsauc pirms minētā termiņa beigām. Ja otra Līgumslēdzēja Puse neapstiprina, ka saņēmusi paziņojumu, paziņojumu uzskata par saņemtu četrpadsmit (14) dienas pēc tam, kad to saņēmusi Starptautiskā civilās aviācijas organizācija.

 

22.pants

NOLĪGUMA UN TĀ GROZĪJUMU REĢISTRĒŠANA

Šo Nolīgumu un visus tā turpmākos grozījumus Līgumslēdzējas Puses reģistrē Starptautiskajā civilās aviācijas organizācijā.

 

23.panta

STĀŠANĀS SPĒKĀ

Šis Nolīgums stājas spēkā pēc tam, kad abas Līgumslēdzējas Puses ar diplomātiskajām notām paziņojušas viena otrai, ka ir izpildītas visas to konstitucionālās procedūras.

TO APLIECINOT, savu valdību pienācīgi pilnvaroti pārstāvji paraksta šo Nolīgumu.

Parakstīts Varšavā 1999.gada 19.maijā divos eksemplāros latviešu, arābu un angļu valodā, turklāt visi teksti ir vienlīdz autentiski. Domstarpību gadījumā priekšroka dodama tekstam angļu valodā.

I. Latvijas maršruti

Marokas Karalistes valdības nozīmētajām aviokompānijām ir tiesības veikt Nolīgumā paredzēto satiksmi abos virzienos šādos maršrutos:

Punkti Marokā - 4 (četri) starppunkti - punkti Latvijā - 3 (trīs) punkti aiz Latvijas robežām

Piezīmes:

1. Katras Līgumslēdzējas Puses nozīmētās aviokompānijas jebkurā vai visos lidojumos var izlaist jebkurus starppunktus vai punktus aiz valsts robežām, ja Nolīgumā paredzētā stiksme noteiktajos maršrutos sākas vai beidzas tās Līgumslēdzējas Puses valsts teritorijā, kas nozīmējusi aviokompāniju.

2. Par starppunktiem un punktiem aiz valsts robežām, kā arī piektās gaisa brīvības tiesību izmantošanu vienojas abu Līgumslēdzēju Pušu aviācijas institūcijas.

Bilateral Air Transport Agreement

between

the Government of the Kingdom of Morocco

and

the Government of the Republic of Latvia

 

The Government of the Kingdom of Morocco and the Government of the Republic of Latvia (hereinafter referred to as the “Contracting Parties”),

Being parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December 1944, and

Desiring to conclude an agreement for the purpose of establishing and developing air services between and beyond their respective territories,

Have agreed as follows:

 

Article 1

DEFINITIONS

For the purpose of this Agreement, unless the context otherwise requires;

(a) the term “Convention” means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December 1944 and includes any Annexes adopted under Article 90 of the Convention and any amendment of the Convention in accordance with Article 94, so far as those Annexes and amendments have been ratified or adopted by both Contracting Parties;

(b) the term “Agreement” means the present Agrreement including its Annex and each modofication which will be applied to them;

(c) the term “aeronautical authorities” means:

For the Goveernment of the Kingdom of Morocco, the Minister responsible for Civil Aviation (Direction de l’Aé ronautique Civile);

For the Government of the Republic of Latvia, the Ministry of Transport, and in both cases any person or body authorised to perform civil aviation functions or similar functions;

(d) the term “agreed services” means the air services established on the specified routes pursuant to Article 2 paragraph 1 of this Agreement;

(e) the terms “air service”, “international air service”, “airline” and “stop for non-traffic purposes” have the meaning respectively assigned to them in Article 96 of the Convention;

(f) the term “aircraft equipment” means articles, other than stores and spare parts of a removable nature, for use on board an aircraft during flight, including first-aid and survival equipment;

(g) the term “designated airlines” means one or more airlines which have been designated by a Contracting Party and authorised by the other Contracting Party in accordance with Article 3 (Designation of Airlines) of this Agreement;

(h) the term “spare parts” means articles of a repair or replacement nature for incorporation in an aircraft, including engines and propellers;

(i) the term “specified routes” means the routes specified in the Annex to this Agreement;

(j) the term “stores” means articles of a readily consumable nature for use or sale on board aircraft during flight, including commissary supplies;

(k) the term “tariffs” means the prices to be paid for the carriage of passengers, baggage, cargo and the conditions under which these prices apply, including prices, commissions and conditions of agency and other auxiliary services, but excluding remuneration and conditions for the carriage of mail;

(l) the term “territory” means in relation to a State the land areas, internal waters, and territorial seas adjacent thereto under the sovereignty of such State.

 

Article 2

GRANTING OF RIGHTS

1. Each Contracting Party grants to the other Contracting Party the right to establish air services on the routes specified in the appropriate section of the Annex.

2. Each Contracting Party grants to the other Contracting Party the following rights in respect of its scheduled international air services:

(a) the right to fly across its territory without landing;

(b) the right to make stops in its territory for non-traffic purposes; and

(c) to make stops in the said territory at the points specified for that route in the Annex to this Agreement for the purpose of putting down and taking on international traffic passengers, cargo and mail, in accordance with the provisions of this Agreement.

3. Nothing in this Article shall be deemed to confer on the designated airline(s) of one Contracting Party the right of taking on board, in the territory of the other Contracting Party, passengers, cargo and mail destined for another point in the territory of the other Contracting Party.

 

Article 3

DESIGNATION OF AIRLINES

1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party one or more airline(s) as the airline which shall operate the agreed services on the specified routes.

2. On receipt of notice of such designation, the aeronautical authorities of the other Contracting Party shall, subject to the provisions of the present Article and Article 4, without delay grant to the airline(s) designated in accordance with paragraph 1 of the present Article the appropriate operating authorisation.

3. For the purpose of granting the appropriate operating authorisation under paragraph 2 of the present Article, the aeronautical authorities of one Contracting Party may require the airline(s) designated by the other Contracting Party to satisfy them that it is qualified to fulfil the conditions prescribed under the laws and the regulations normally applied to the operation of international air services by such authorities in conformity with the provisions of the Convention.

4. When an airline has been designated and authorised in accordance with this Article, it may operate the agreed services for which it is designated provided that tariffs established in accordance with the provisions of Articles 5 (Approval of Timetables) and 10 (Tariffs) of this Agreement are in force in respect of that service and shall at all times be adhered to by that designated airline(s).

 

Article 4

REVOCATION OR SUSPENSION

OF OPERATING AUTHORIZATION

1. Each Contracting Party shall have the right to revoke an operating authorisation or to suspend the exercise of the rights granted under the Article 3 of this Agreement to a designated airline(s) of the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of such rights, if:

(a) the mentioned designated airline cannot prove that it is qualified to fulfil the conditions prescribed under the laws and regulations normally applied to the operations of international air services by such authorities in conformity with the provisions of the Convention; or

(b) the said airline fails to operate in accordance with the conditions prescribed under this Agreement; or

(c) the designated airline fails to comply with the laws or regulations in force in the territory of the Contracting Party granting such rights; or

(d) the said airline cannot prove that a preponderant part of its ownership and effective control are vested in the Contracting Party designating the airline or in its nationals.

2. Unless immediate exercise of the right to revoke, suspend or impose conditions conferred by paragraph 1 of the present Article is essential to prevent further infringements of the laws or regulations or the provisions of this Agreement, such right shall be exercised only after consultation with the aeronautical authorities of the other Contracting Party in conformity with Article 17 of the present Agreement.

 

Article 5

APPROVAL OF TIMETABLES

1. The designated airline(s) of either Contracting Party shall, not later than thirty (30) days prior to the date of the operation of any agreed services, submit its proposed timetables to the aeronautical authorities of the other Contracting Party for its approval.

Such timetables shall include the type of service, aircraft to be used, the flight schedule, tariffs, conditions of carriage and all relevant information.

2. If the designated airline(s) wishes to operate supplementary or additional flights besides those covered in the approved timetables, it shall first obtain the permission of the aeronautical authorities of the Contracting Party concerned.

3. Any subsequent changes to the approved timetables of the designated airline(s) shall be submitted for approval to the aeronautical authorities of the other Contracting Party.

 

Article 6

PRINCIPLES GOVERNING THE OPERATION OF

AGREED SERVICES

1. The designated airlines of the two Contracting Parties shall be afforded fair and equitable treatment in order that they may enjoy equal opportunity in the operation of the agreed services. However, in operating the agreed services, the designated airlines shall take into account their mutual interests so as not to affect unduly their respective services.

2. The operation of the third and fourth freedom traffic rights between the territories of the Contracting Parties in both directions along the specified routes constitutes a basis and primary right each Contracting Party.

3. For the operation of the agreed services:

(a) the total capacity provided on each of the specified routes shall be determined having regard to the actual and reasonably anticipated traffic requirements;

(b) the designated airlines of the two Contracting Parties shall share in equal proportion the capacity referred to in paragraph (a) of the present Article.

4. In order to meet seasonal fluctuations of traffic or unexpected traffic demands of a temporary character, the designated airlines of the two Contracting Parties shall consult between themselves on suitable measures to be adopted in such situations. Any arrangements concluded in this regard between the airlines and any amendment thereto shall be submitted for approval to the aeronautical authorities of the two Contracting Parties.

5. In case of one of the Contracting Party doesn’t desire to operate on one or more routes, a part or totality of transport capacity which has been conceeded, it shall agree with the other Contracting Party to transfer to it for a determinated period of time, the totality or one part of transport capacity which is provided for it.

The Contracting Party which has transfered all or one part of its rights can take back them at the end of the said period.

 

Article 7

APPLICATION OF LAWS AND REGULATIONS

1. The laws and regulations of one Contracting Party relating to admission to, flight within or departure from its territory of an aircraft of its designated airline(s) engaged in international air navigation, or to the operation or navigation of such aircraft while within its territory, shall likewise apply to the aircraft of designated airlines(s) of the other Contracting Party and shall be complied with by such aircraft upon entering or departing from or while within the territory of that Contracting Party.

2. The laws and regulations of one Contracting Party relating to admission to, stay in, or departure from its territory of passengers, baggage, crew, cargo or mail, such as laws and regulations relating to entry, exit, emigration, immigration, passports as well as customs and health or sanitary measures, shall apply to passengers, baggage, crew, cargo and mail carried by the aircraft of the designated airline(s) of the other Contracting Party upon entry into departure from or while within the territory of the said Contracting Party. Such laws and regulations shall equally apply to the designated airline(s) of one Contracting Party as they apply to the designated airline(s) of the other Contracting Party.

 

Article 8

USER CHARGES OF AIRPORTS, INSTALLATIONS AND SERVICES

When utilising the airports and other facilities offered by one Contracting Party, the aircraft of the designated airline of the other Contracting Party shall pay the same level of fees as those which have to be paid by national aircraft on scheduled international services.

 

Article 9

REPRESENTATION OF AIRLINES

1. Each Contracting Party shall grant, on a basis of reciprocity, to the designated airline(s) of the other Contracting Party the right to maintain in its own territory representation with the technical, administrative and commercial personnel indispensable for its operations.

2. For the operation of its services, the designated airline(s) shall have the right to employ technical, administrative and commercial personnel of its own nationality subject to the laws and regulations in force in the country in which this personnel is to be employed.

 

Article 10

TARIFFS

1. The tariffs to be charged by the airline(s) of one Contracting Party for carriage to or from the territory of the other Contracting Party shall be established at reasonable levels with due regard being paid to all relevant factors, including cost of operation, reasonable profit and the tariffs of other airlines.

2. The tariffs referred to in paragraph (1) of the present Article, shall, wherever possible, be agreed by the designated airlines of both Contracting Parties after consultation with the other airlines operating over the whole or part of the route, and such agreement shall, whenever possible, be reached by following the procedures of the International Air Transport Association for the calculation of tariffs.

3. The tariffs so agreed shall be submitted, for the approval of the aeronautical authorities of both Contracting Parties, at least thirty (30) days before the proposed date of their introduction (hereinafter referred to as the “period of notice”). In special cases, the period of notice may be reduced, subject to the agreement of the said authorities.

4. The approval referred to in paragraph (3) of the present Article may be given expressly. If neither of the aeronautical authorities has expressed disapproval of the tariffs within thirty (30) days from the date of submission in accordance with paragraph (3), the tariffs shall be considered as approved. In the event of the period of notice being reduced as provided for in paragraph (3), the aeronautical authorities may agree that the period within which any disapproval must be notified shall be less than thirty (30) days.

5. If the aeronautical authorities cannot agree on any tariff submitted to them under paragraph (3) or on the determination of any tariff under paragraph (4), the dispute shall be settled in accordance with the provisions of Article 20 (Settlement of Disputes) of this Agreement.

6. A tariff established in accordance with the provisions of this Article shall remain in force until a new tariff has been established. Nevertheless, a tariff shall not be prolonged by virtue of the present paragraph:

(a) where such tariff has a terminal date, for more than twelve (12) months after that date and;

(b) where such tariff has no terminal date, for more than twelve (12) months after the date on which the designated airline(s) of one Contracting Party, in writing to the aeronautical authorities of the Contracting Parties, proposed a new tariff in accordance with the provisions of this Agreement.

7. Each Contracting Party shall ensure that all the airlines operating services to or from its territory respect strictly the tariffs approved in accordance with the provisions of the present Article.

 

Article 11

EXCHANGE OF STASTISTICAL INFORMATION

The aeronautical authorities of each Contracting Party shall supply to the aeronautical authorities of the other Contracting Party, on request by letter, information relating to the traffic carried on the agreed services by the respective designated airline(s). Such information shall include statistics and other information required in determining the amount of traffic carried by those airlines on the agreed services.

 

Article 12

RECOGNITION OF CERTIFICATES AND LICENCES

Certificates of airworthiness, certificates of competency and licences issued or rendered valid by one Contracting Party and still in force, shall be recognised as valid by the other Contracting Party for the purpose of operating the routes and services provided for in this Agreement, provided that the requirements under which such certificates or licences were issued or rendered valid are equal to or above the minimum standards which are or may be established pursuant to the Convention.

Each Contracting Party reserves the right, however, not to recognise as valid, for the purpose of flights over its own territory, certificates of competency and licences granted to its own nationals or rendered valid for them by the other Contracting Party or by any other state.

 

Article 13

AVIATION SECURITY

1. Consistent with their rights and obligations under international law, the Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against acts of unlawful interference forms an integral part of this Agreement. Without limiting the generality of their rights and obligations under international law, the Contracting Parties shall in particular act in conformity with the provisions of the Convention of Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at The Hague on 16 December 1970, the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971 and the protocol for the Suppression of Unlawful Acts of violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988, and any other multilateral agreement governing Civil aviation security binding upon both Contracting Parties.

2. The Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.

3. The Contracting Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organisation and designated as Annexes to the Convention on International Civil Aviation to the extent that such security provisions are applicable to the Contracting Parties; they shall require that operators of aircraft of their registry, or operators of aircraft who have their principal place of business or permanent residence in their territory, and the operators of airports in their territory, act in conformity with such aviation security provisions.

4. Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in paragraph 3 above required by the other Contracting Party to entry into, departure from, or while within, the territory of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its territory to protect the aircraft and to inspect passengers, crew, carry-on items, baggage, cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also give sympathetic consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.

5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful act against the safety of such aircraft, their passengers and crew, airports and air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof.

 

Article 14

EXEMPTION FROM CUSTOMS DUTIES, INSPECTION FEES

AND OTHER SIMILAR CHARGES

1. Aircraft operated on the agreed services by the designated airline(s) of either Contracting Party, as well as any aircraft equipment, supplies of fuels and lubricants, and aircraft stores (including food, beverages and tobacco) on board such aircraft shall be exempt from all customs duties, inspection fees and other similar charges on arriving in the territory of the other Contracting Party, provided that such equipment, supplies and stores remain on board the aircraft up to such time as they are re-exported or are used on the part of the journey performed over that territory.

2. Subject to paragraph (3) of the present Article, there shall also be exemption from customs duties, inspection fees and similar charges, with the exception of charges corresponding to the services performed:

(a) aircraft stores taken on board in the territory of a Contracting Party; within limits fixed by the aeronautical authorities of that Contracting Party, and for use on board outbound aircraft engaged on an agreed services of the other Contracting Party;

(b) spare parts introduced into the territory of either Contracting Party for the maintenance or repair of an aircraft used on the agreed services by the designated airline(s) of the other Contracting Party;

(c) fuel and lubricants to be supplied to an inbound/transiting/outbound aircraft operated on agreed services by the d esignated airline(s) of the other Contracting Party, even when such supplies are to be used on the part of the journey performed over the territory of the Contracting Party in which they are taken on board.

3. Material and supplies referred to in paragraph 2 (a), (b) and (c), may be subject to customs surveillance or control, of the two Contracting Parties.

4. Baggage and cargo in direct transit shall be exempt from customs duties and other similar taxes provided that these will be under customs surveillance or control.

5. The regular airborne equipment, as well as the materials and supplies retained on board an aircraft of the designated airline(s) of either Contracting Party, may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of that other Contracting Party and such customs authorities may require that such equipment, materials and supplies be placed under their surveillance up to such time as they are re-exported or otherwise disposed of in accordance with customs laws and regulations.

 

Article 15

SALES, RECEIPTS AND TRANSFER OF EARNINGS

1. Each designated airline has the right to proceed to the sale of air transport tickets on the other Contracting Party territory directly and, as one likes, by the intermediate of its agents. These sales must be operated in the local currency.

2. Each Contracting Party grants to the designated airline(s) of the other Contracting Party the right of free transfer of the excess of receipts over expenditure earned by the designated airline(s) in the territory of such Contracting Party in connection with the carriage of passengers, baggage, cargo and mail, as well as from any other activities related to air transport which may be permitted under national regulations. Such transfers shall be effected at the rate of exchange in accordance with the respective applicable national laws and regulations governing current payments, but where there is no official exchange rate such transfers shall be effected at the prevailing foreign exchange market rate for current payments.

3. In the event that the form of payment between the Contracting Parties is governed by a special agreement, such an agreement will apply.

 

Article 16

PLACE OF TAXATION

The revenue derived from international traffic operations by an airline designated by Contracting Party, will be taxable only in the state where the headquarters of the said designated airline are situated.

 

Article 17

CONSULTATIONS

1. In a spirit of close co-operation the aeronautical authorities of the Contracting Parties shall counsult each other from time to time with a view to ensuring the implementation of, and satisfactory compliance with, the provisions of this Agreement and the Annex attached hereto and shall consult whenever necessary to provide for modification to this Agreement or the Annex.

2. Either Contracting Party may request consultations which may be through discussion or by correspondence.

In the case of discussion, they shall begin within a period of thirty (30) days of the date of the request unless both Contracting Parties agree to an extension of this period.

 

Article 18

AMENDMENTS

Any amendment of this Agreement shall be effected by an exchange of Notes and shall enter into force on such date as is provided for in the exchange of Diplomatic Notes.

 

Article 19

ADAPTATION TO MULTILATERAL CONVENTION

This Agreement shall be amended so as to conform to any multilateral agreement which may become binding on both Contracting Parties.

 

Article 20

SETTLEMENT OF DISPUTES

1. If any dispute arises between the Contracting Parties relating to the interpretation or application of this Agreement, the Contracting Parties shall in the first place endeavour to settle it by direct negotiations.

2. If the Contracting Parties fail to reach a settlement by direct negotiations, they may refer the dispute for decision to some person or competent body from a third State.

3. If a settlement cannot be reached by the aforementioned methods, the dispute shall, at the request of either Contracting Party, be submitted for decision to a tribunal (hereinafter called the ”Arbitral Tribunal”) consisting of three arbitrators, one to be appointed by each Contracting Party and the third to be appointed by the two so appointed.

4. Each of the Contracting Parties shall appoint an arbitrator within a period of sixty (60) days from the date of receipt by either Contracting Party from the other of a notice through the diplomatic channel requesting arbitration of the dispute by the Arbitral Tribunal and the third arbitrator shall be appointed within a further sixty (60) days. If either of the Contracting Parties fails to appoint an arbitrator within the specified period or if the third arbitrator is not appointed within the specified period the President of the Council of the International Civil Aviation Organisation may be requested by either Contracting Party to appoint an arbitrator or arbitrators as the case requires.

5. The third arbitrator appointed under paragraph (3) shall be a national of a third state and shall act as President of the Arbitral Tribunal.

6. The Arbitral Tribunal shall determine its own procedure.

7. Subject to the final decision of the Arbitral Tribunal, the Contracting Parties shall bear in equal proportion the cost of arbitration.

8. The Contracting Parties shall comply with any provisional ruling or the final decision of the Arbitral Tribunal.

9. If, and so long as, either Contracting Party fails to comply with a decision of the Arbitral Tribunal given under this Article, the other Contracting Party may limit, withhold or revoke any rights or privileges which it has granted by virtue of the present Agreement to the Contracting Party in default.

 

Article 21

TERMIANTION OF AGREEMENT

Either Contracting Party may at any time give notice in writing to the other Contracting Party of its intention to terminate this Agreement. Such notice shall be communicated simultaneously to the International Civil Aviation Organisation. In such case this Agreement shall terminate twelve (12) months after the date on which the notice was received by the other Contracting Party unless the notice to terminate is withdraw by agreement before the expiry of this period. In the absence of acknowledgement of receipt by the other Contracting Party, the notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by International Civil Aviation Organisation.

 

Article 22

REGISTRATION OF AGREEMENT AND AMENDMENTS

This Agreement and any subsequent amendments thereto shall be registered with the International Civil Aviation Organisation by the Contracting Parties.

 

Article 23

ENTRY INTO FORCE

This Agreement shall enter into force as soon as the two Contracting Parties have notified to each other by an exchange of Diplomatic Notes the fulfilment of their respective constitutional procedures.

IN WITHNESS WHEREOF the undersigned duly authorised by their respective governments, heve signed this Agreement.

 

DONE at Warsaw on May 19th, 1999, is duplicate in the Arabic, Latvian and English languages all texts being equally authentic. In case of any divergence, the English text shall prevail.

ANNEX

ROUTES

I LATVIAN ROUTES

The airlines designated by the Government of the Republic of Latvia shall be entitled to operate the agreed services in either or both directions on the following routes:

Points in Latvia - 04 (Four) intermediate points - Points in Morocco - 03 (Three) beyond points.

 

II MOROCCAN ROUTES

The airlines designated by the Government of the Kingdom of Morocco shall be entitled to operate the agreed services in either or both directions on the following routes:

Points in Morocco - 04 (Four) intermediate points - Points in Latvia - 03 (Three) beyond points

 

Notes:

1. The designated airlines of either Contracting Party may on any or all flights omit calling at any of the intermediate points or beyond points provided that the agreed services on these routes begin/terminate at a point in the territory of the Contracting Party designated the airline.

2. The determination of intermediate and beyond points and the exercise of fifth freedom traffic rights shall be agreed between both aeronautical authorities.
